We, us, our: Mr. Aventus, trading as PupClarity, established in Veghel, the Netherlands.
You, the buyer: the individual purchasing digital content from us other than in the course of a business.
Digital content: data produced and supplied in digital form, being the PupClarity guides and worksheets.
Distance contract: a contract concluded through our website without our simultaneous physical presence.
2.1 These terms apply to every offer we make and every contract concluded through our website.
2.2 These terms are made available electronically before the contract is concluded, in a form you can save and reproduce.
2.3 We sell to individuals only. We do not knowingly sell to anyone under the age of 18.
3.1 Each offer contains a complete and accurate description of the digital content being sold, including its length and format.
3.2 Obvious errors or mistakes in an offer do not bind us.
3.3 All prices are shown in the currency stated and include any tax we are required to charge. No delivery or additional charges apply.
3.4 We do not display a struck-through reference price unless that price was genuinely charged during the preceding period. We do not use countdown timers, artificial stock limits, or fabricated reviews.
4.1 The contract is concluded when you accept the offer and meet the stated conditions.
4.2 We confirm receipt of your order electronically without delay.
5.1 Digital content is delivered electronically immediately after payment is received, by means of a download link sent to the email address you provide.
5.2 Download links expire seven days after they are issued. If your link has expired, or you did not receive it, contact [email protected] and we will issue a replacement free of charge. This applies for as long as we continue to sell the product and, in any event, for no less than two years from your purchase.
5.3 You are responsible for providing a correct email address. If delivery does not arrive, contact us and we will resend at no cost.
5.4 Accessing the digital content requires a device capable of opening PDF files.
6.1 If you are resident in the European Union or the United Kingdom, you have a statutory right to cancel a distance contract within 14 days.
6.2 For digital content not supplied on a tangible medium, that right is lost where, when placing the order, you have:
This consent is requested explicitly at checkout by means of a tick box that must be actively selected. Without it, immediate delivery does not take place.
6.3 If you are resident elsewhere, statutory cancellation rights may not apply to digital content. The guarantee in Article 7 applies to you regardless of where you live.
6.4 Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law, the UK Consumer Rights Act 2015, or any equivalent mandatory provision applying where you live.
6.5 Regardless of the above, we operate our own satisfaction guarantee, set out in Article 7. That guarantee is broader than any statutory cancellation right and operates independently of Article 6.2.
7.1 In addition to your legal rights, PupClarity offers a voluntary 30-day satisfaction guarantee. This guarantee applies in addition to and not instead of your legal rights.
7.2 If you are not satisfied, email [email protected] within 30 days of your purchase. You may give a reason, but you do not have to. You will receive the full purchase price back within 14 days via the same payment method, at no cost. You may keep the guide.
8.1 Payment is made using the methods offered on the website.
8.2 Payment is processed by an external payment service provider. We do not receive or store complete payment details.
9.1 All intellectual property rights in the digital content belong to us.
9.2 You receive a non-transferable licence to use the content for personal, non-commercial purposes.
9.3 You may not reproduce, publish, resell, redistribute or otherwise make the digital content available to third parties.
9.4 You may of course print the content and use it within your own household.
10.1 PupClarity digital content is educational and informational. It provides general information about normal young-dog behaviour.
10.2 It is expressly not a substitute for veterinary advice, or for guidance from a certified dog behaviour professional who assesses the individual dog in person.
10.3 The content is not intended for dogs showing aggression, fear-related problems, resource guarding, or dogs that have caused injury. In those cases we expressly recommend professional guidance. This is also stated within the content itself.
10.4 You remain responsible at all times for the behaviour, welfare and supervision of your own dog, and for the safety of people around it.
10.5 We are not liable for loss arising from application of the information, save for intent or deliberate recklessness on our part. Nothing in this article limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.
11.1 Complaints may be submitted to [email protected] and will be answered within 14 days.
11.2 If we cannot resolve the matter, EU-resident consumers may refer the dispute to the European ODR platform: https://ec.europa.eu/consumers/odr
12.1 Contracts between us and you are governed by the law of the Netherlands.
12.2 Mandatory consumer protection provisions of the country in which you are resident continue to apply in full, and nothing in clause 12.1 deprives you of the protection of those provisions.
